Terms of Service

1. Acceptance of Terms
By accessing or using DailyTick (the “Service”), you agree to be bound by these Terms of Service. DailyTick is operated by The Lost Co, an Australian company. If you do not agree to these terms, do not use the Service.
2. Description of Service
DailyTick is a habit tracking application that allows users to create habits, track daily completions, set goals, earn achievement badges, and view analytics on their progress. The Service is available as a Progressive Web App accessible via web browsers.
3. Accounts
- You must provide a valid email address to create an account.
- You are responsible for maintaining the security of your account credentials.
- You must be at least 16 years of age to use the Service.
- You may not use the Service for any unlawful purpose.
- One person may not maintain more than one free account.
4. Free and Paid Plans
DailyTick offers both free and paid (Pro) tiers:
- Free: Limited to 3 active habits, 1 active goal, 7-day analytics, and 1 streak save per month.
- Pro (Monthly/Yearly): Unlimited habits and goals, full analytics, all badge tiers, and 5 streak saves per month. Billed as a recurring subscription.
- Pro (Lifetime): One-time payment for permanent access to all Pro features, plus 10 streak saves per month.
All prices are displayed in Australian Dollars (AUD). We reserve the right to change pricing with 30 days notice.
5. Payments & Refunds
- Payments are processed securely by Stripe.
- Subscriptions automatically renew unless cancelled before the next billing period.
- You can cancel your subscription at any time from the Settings page. Access continues until the end of the current billing period.
- Refunds for subscriptions are handled on a case-by-case basis. Contact us within 14 days of purchase.
- Lifetime purchases are non-refundable after 14 days, except where required by Australian Consumer Law.
6. Your Data
- You retain ownership of all data you create within DailyTick.
- You can export your data at any time from the Settings page.
- You can delete all your data at any time from the Settings page.
- We handle your data in accordance with our Privacy Policy and the Australian Privacy Act 1988.
7. Acceptable Use
You agree not to:
- Attempt to gain unauthorised access to any part of the Service.
- Use automated systems or bots to access the Service.
- Interfere with or disrupt the Service or its infrastructure.
- Use the Service to store or transmit malicious code.
- Resell or redistribute the Service without written permission.
8. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We are not liable for any loss resulting from service interruptions.
9. Limitation of Liability
To the maximum extent permitted by law, The Lost Co shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Nothing in these terms excludes or limits liability that cannot be excluded under Australian Consumer Law.
10. Termination
We may suspend or terminate your account if you violate these terms. You may delete your account at any time. Upon termination, your data will be permanently deleted in accordance with our Privacy Policy.
11. Governing Law
These terms are governed by the laws of Australia. Any disputes arising from these terms or the Service shall be subject to the exclusive jurisdiction of the courts of Australia.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or in-app notification with at least 30 days notice. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
